E Cigarette
As the regulation of tobacco companies, increases on sin taxes, and indoor smoking bans have evolved over the past few years, a multitude of consumers have switched over to electronic cigarettes. And fortunately for e-smokers the government has decided not to increase their consumer costs. The Food and Drug Administration lost a case last year when trying to regulate e-cigarettes as drug-delivery devices rather than tobacco products. This drug-delivery device classification would have forced manufacturers to undergo a pre-market approval process, making requirements more stringent and clinical trials more expensive. But the FDA announced Monday that it plans to regulate e-cigarettes just like it regulates regular tobacco products. The recent decision by the U.S. Court of Appeals in Sottera Inc. v. Food & Drug Administration held that e-cigarettes and other products made or derived from tobacco can be regulated as tobacco products under the [Family Smoking Prevention & Tobacco Control Act of 2009] and are not drugs/devices unless they are marketed for therapeutic purposes. Something tells me this wont be the end of it. Despite the fact that e-cigarettes emit vapor rather than smoke, politicians in some cities still want to ban indoor use of e-cigarettes. Apparently, secondhand vapor is a real killer.
